Introduction
We respectfully remind guests that a ‘Guest House’ reservation constitutes a contract. We reserve the right to alter our Guest House prices for any reason up to the date of booking.
These are the terms and conditions that apply when you reserve a room at the The Thoresby Guest House, Scarborough.
We reserve the right to amend these terms and conditions at any time and you should therefore check them each time you make a reservation. The terms and conditions applying to your reservation will be those in place on the date that you make your reservation.
Cancellations, amendments and no shows
There will be no cancellation charge if a booking is cancelled 7 days before your date of arrival. In the event of a cancellation less than 7 days before arrival, the total cost of the first night will become payable. On minimum stay periods the full amount will be liable for payment in the event of a cancellation less than 7 days before arrival. A 2 night minimum stay applies some weekends. A 3 night minimum stay applies at event or bank holiday weekends.
(Please note that for group booking i.e. 3 rooms or more, in the event of a cancellation less than 14 days before arrival, the total cost of the first night will become payable).
In the event of a No-show/Non arrival, the whole amount of total stay booked will be charged.
All amendments must be completed 7 days before the day of your original check-in date. You cannot amend a booking after this time.

If you need to cancel please contact us immediately or if the booking is through a third party, then cancel through them. We advise you to take out holiday insurance to cover any losses incurred.
If you book non-refundable room rate(s), payment in full is taken at the time of booking and because room(s) are made available at a discounted rate, these room(s) bookings cannot be amended or refunded.
Our right to cancel
Your breach:
We may cancel your reservation at any time with immediate effect by giving you written notice (which includes email) if you do not pay us when you are required to do so; or you break the contract between us in any other material way.
If we cancel your reservation where you are at fault, we reserve our legal rights in respect of your breach of contract.
Events outside our control:
We may also cancel your reservation if an event outside of our control (including industrial action, explosion, fire, flooding, and failure of power and/or water supplies or emergency evacuation) means that we are unable to make your room available to you. In this case we will contact you to let you know as soon as possible and:
if you have already paid for your room, we will refund your payment to you; or
if you have not yet paid for your room, you will not have to make any payment to us.
Save as set out above, we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an event outside of our control.
This does not affect your statutory rights.
Reservations
You must be at least 18 years old to make a reservation.
Please check that the details of your reservation are complete and accurate before you confirm your reservation. We will not be liable for any delay or non-performance if you provide us with incorrect information.
We will confirm our acceptance of your reservation by sending you an email to the email address that you provide during the reservation process. The contract between us for the provision of your room and any additional services added to your reservation will be formed when you receive this email confirmation from us.
If you think that there is a mistake in your reservation or if you require any changes to a confirmed reservation, please contact us to discuss.
Room prices
The Thoresby Guest House adopts dynamic pricing and the price of our rooms fluctuates based on demand. Room prices are per room, per night and when you make a reservation request, we’ll give you a total price for the rooms and number of nights you’ve requested. The price you pay is the price quoted to you at the time you make your reservation.
Occupancy
The maximum room occupancy is two adults for a double or twin with upto 3 adults in a quad room.
Check-in/Check-out Policy:
Rooms are available from 2 pm on the arrival date, and rooms must be vacated by 10 am on the day of departure. All guest house room keys and car parking permits must be returned to us on check-out. If you don’t do this we may charge you for a replacement key and/or permit as required.
Rates quoted are based on check-in date and length of stay shown. Should you depart early prior to the departure date confirmed for any reason, we may impose an early departure fee. Any changes to the arrival date, departure date, or room type of a reservation is subject to the our availability at the time the change is requested and may result in a possible rate change.
We do not operate a 24-hour reception service, but owners are generally available during check-in (2-6 pm), check-outs (8-10 am). At other times, when the owners are for example in town, you can generally contact by calling our number 01723 365715
Paying for your room
You’ll be asked to pay when you check in if your payment is not pre-taken, so you can be sure of a quick and easy departure on the day you leave. We accept the following methods of payment: Cash, Visa, Mastercard. Sorry, no cheques. If you’re paying by cash, we will ask you for identification when you check-in i.e. photo ID (passport or driver’s license), showing a credit or debit card will not be accepted as proof of ID.
If you wish to pay in advance, simply pay the full amount to credit our account prior to arrival.
Please state Guest Full Name, as reference, when making a bank transfer.
We will send you email confirmation upon receipt of payment.
The Thoresby Guest House reserves the right to pre-authorise your card for the full amount of your reservation, 7 days prior to arrival. Note: If you book non-refundable room rate(s), payment in full is taken at the time of booking and because room(s) are made available at a discounted rate, these room(s) bookings cannot be amended or refunded.
The Thoresby Guest House expectations of you (and your group)
We are unable to accept children younger than 3 years as our guest house has mixed usage, adults and families
We don’t allow pets to stay at The Thoresby.
This is strictly a Non Smoking Guest House. Any guest found to be smoking in their room may be asked to leave. Should you wish to smoke please do so outside where receptacles are available for extinguishing cigarettes. This is to prevent sensitive fire alarms from going off and disturbing other guests and in order that the premises insurance policy is not affected. Your assistance in this matter is greatly appreciated.
Guests arriving late (after reception closes) are required to contact The The Thoresby Guest House prior to their arrival where a member of staff will be able to advise you about access codes and where you will be able to retrieve a key to your room.
Please take care with our accommodation. You are responsible and liable for any breakages or damages which you cause to the accommodation or its contents. Please report these as soon as they occur. We do not normally charge for minor breakages, but we may send you an invoice for repair or making good if the damage or breakage is significant, and we may make an additional charge if you did not report this.

We reserve the right to charge guests the cost of replacing any items that are removed from the premises without consent. The charge will be the full replacement amount of the missing item, including any carriage charges. Should the fact that the item is missing come to light after the guest has departed, we reserve the right to make a charge to the guests credit / debit card, or send an invoice for the amount to the registered address.

No fuel, gas or electric cooking appliances are allowed in guest rooms; i.e. gas or electric hobs, microwaves, sandwich makers or grills. For your safety the use of incense sticks, candles, or alike are not permitted to be used on the premises as this can be a fire hazard.

Visitors to guest rooms are permitted, but are not allowed to stay overnight and must leave guest rooms no later than 10:45 pm.
In the event of damage and/or smoking in the bedrooms or building premises, we reserve the right to charge a minimum fee of: £75.00

HOTEL PROPRIETORS ACT 1956
Loss of or Damage to Guests’ Property
Under the Hotel Proprietors Act 1956, an hotel proprietor may in certain circumstances be liable to make good any loss of or damage to a guest’s property even though it was not due to any fault of the proprietor or staff of the hotel.
This liability however—
(a)extends only to the property of guests who have engaged sleeping accommodation at the hotel;
(b)is limited to £50 for any one article and a total of £100 in the case of any one guest, except in the case of property which has been deposited, or offered for deposit, for safe custody;
(c)does not cover motor-cars or other vehicles of any kind or any property left in them, or horses or other live animals.
This notice does not constitute an admission either that the Act applies to this hotel or that liability there under attaches to the proprietor of this hotel in any particular case.
We do not accept any liability for any damage, loss or injury to any member of your party or any vehicles or possessions, unless proven to be caused by a negligent act by ourselves.
FORCE MAJEURE
We do not accept liability or pay compensation for any loss, damage or expense where the performance or prompt performance of our obligations is prevented or affected by reason of force majeure. Force Majeure means any event which The Thoresby Guest House could not, even with all due care, foresee or avoid such as war or threat of war, riots, civil strife, terrorist activity, industrial action, natural or nuclear disaster, fire, adverse weather conditions, closure of airports or ports, technical problems with transport, governmental action and all other similar events. You will receive a full refund of any monies paid to us.
The contract
This contract formed when we confirm your reservation is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.
Your rights
If you are a non-business customer you have certain rights under consumer protection legislation. Nothing in these terms and conditions is intended to affect those rights.
Our liability
We accept liability for death and personal injury arising from our negligence or that of our agents. We do not seek to exclude our liability for fraudulent misrepresentation by us or our agents.

We do not accept liability for failure to meet any of our obligations where such failure is due to events beyond our reasonable control.
If we breach these terms and conditions for reasons within our control we shall only be liable for losses that are direct losses and a reasonably foreseeable consequence of such breach.
We shall not be liable whether in contract, tort (including negligence) or for breach of statutory duty, or in any other way, for any indirect or consequential losses including:
loss of income, sales or revenue;
loss of business;
business interruption;
loss of profits or contracts;
loss of anticipated savings;
loss of data;
loss of reputation and/or goodwill; or
wasted management or office time.
Where we are liable to you (save as prohibited by applicable law) our maximum liability to you whether in contract, tort (including negligence) or for breach of statutory duty shall in no event exceed the price of your reservation unless the Hotel Proprietor’s Act 1956 applies, in which case our liability will be limited to the maximum prescribed under that Act.
Applicable law
These terms and conditions, their subject matter and formation (and any non-contractual disputes or claims) are governed by and construed in accordance with English law.
If you are a consumer you and we both agree that the courts of England and Wales will have non-exclusive jurisdiction over any claim arising from, or related to, your reservation and/or stay at The Thoresby Guest House. We retain the right to bring proceedings against you for breach of these terms and conditions in your country of residence or any other relevant country. If you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
If you are making a business reservation, you and we agree that the courts of England and Wales will have exclusive jurisdiction over any claim arising from, or related to your reservation and/or stay at The Thoresby Guest House.
Severability
If any part of these terms and conditions is deemed invalid, illegal or for any reason unenforceable then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under these terms and conditions or otherwise shall not be construed as a waiver by us of those or any other rights or remedies.
All rights not expressly granted in these terms and conditions are reserved.
